Tara, who works as a waitress, has two young children and only comes in two or three mornings a week, and never at all during the school holidays. However, because her partner, Sally, has recently lost her job, she has been working five days a week and Sally has been looking after the children.

Dick, who has a minor heart problem, works 40 hours a week doing general maintenance jobs within the hotel. He is getting less and less efficient and there is not a great deal of work for him to do. He has been employed by the hotel for 30 years, is 55 years old and earns £400 a week.

Harry has been employed for two years as a pastry chef. He is twenty years old and very quiet but has been working conscientiously. He has recently been informed that his probationary period is now over and he can consider himself to be a permanent member of staff.

Assume you are based in the HR department of the chain’s Head Office and are required to give legal advice in the following situations (ignoring any discrimination aspects)

(a) Tara has been coming in late to work and the Restaurant Manager, Rick, calls her in one morning and tells her that as she is so unreliable from now on she will not be required to work more than three mornings a week. Tara is very upset and says Sally has been ill and she has had to get the children ready for school. Rick says that is not his problem – he has a restaurant to run and gives her a written warning. He wants to dismiss her as soon as possible.

(b) Dick’s manager, Tom, states that there is really no reason to continue to employ Dick and wants to pay him off. He asks what steps should be taken and the financial consequences of dismissing him with two months notice.

(c) Harry gets involved in a fight after work with a work colleague. Before you have time to investigate this he telephones you at your office and says that feels he needs to tell you that he has a history of drug addiction. He says that he did not want to reveal this until he had proved himself capable and he hopes that this information will remain confidential. You ask to see him and at the meeting Harry gets extremely upset saying that he knows that he is not coping very well and that his colleague (with whom he had the fight) is a bully. He then says he is resigning forthwith and wants to leave immediately
