Olufsen LED are a medium sized United Kingdom based company manufacturing light-emitting diodes for scientific equipment such as microscopes.
The machinery that Olfusen LED uses to manufacture the light-emitting diodes was provided on contract with the company Newmatic. The contract contained a term that in the event of the machines failing Newmatic would fix or replace them within one week of being notified of the failure.
Last September the light-emitting diode manufacturing machinery failed and Olufsen immediately contacted Newmatic to inform them of the fault. Newmatic made several errors in processing the fault notification and they did not fix Olufsen’s machines until four months later in January.
In the interim Olufsen LED had been using older machines which were much less efficient – only allowing Olufsen LED to produce half of the light emitting diodes they could have produced using the Newmatic machines.
Due to the reduced production capacity Olufsen also lose out on a contract to supply light-emitting diodes to another company, Gotech, which would have earned them £50,000.
Write a report advising Olufsen LED if the can successfully claim contractual damages for loss of profits suffered by Newmatics failure. Can they also claim against Newmatic for the profits lost from the Gotech contract?
The report should also explain any alternative dispute resolution methods that Olufsen may wish to consider in their dispute with Newmatic and the relative merits of these methods.
