Case Study:

A 34-year-old woman, Sarah Thompson Drayton, and her groom, Daniel Drayton 26, had severe learning disabilities and their local adult social care services tried to stop them from marrying for nearly a year. "They said Daniel could be charged with raping Sarah. They told us our vicar could be in trouble too," said Thompson.

Six months after the local authority`s adult social care team were first notified about Thompson Drayton`s wedding, she received a capacity assessment which was carried out against both her and her mother`s wishes. It was designed to determine whether she was sufficiently able to have sexual relations and get married without a high risk of abuse or exploitation. She failed the assessment, despite the assessors acknowledging that she had a strong understanding of relationships and marriage.

Principles of Ethics Affected

In the case of Sarah Thompson Drayton and Daniel Drayton, several core ethical principles in health and social care have been undermined. The principle of dignity has been significantly compromised, as Sarah’s autonomy and personal wishes regarding her marriage were disregarded by the local authority. Instead of being respected as an adult capable of making personal life decisions, she was treated in a paternalistic and discriminatory manner.

The principle of respect was also neglected. Sarah’s understanding of her relationship and marriage was undervalued, and her emotional maturity in recognising love, companionship, and commitment was dismissed. This lack of respect for her perspective reinforced stereotypes about people with learning disabilities being incapable of meaningful relationships.

The principle of freedom was denied through restrictions placed upon Sarah and Daniel’s ability to marry. Marriage is both a legal right and a deeply personal life choice, but in this case, their freedom to exercise this right was obstructed by institutional barriers.

Rights and responsibilities were also central in this case. Sarah and Daniel’s human right to family life, as recognised by Article 8 of the European Convention on Human Rights, was infringed. Additionally, the local authority failed in its responsibility to protect these rights in a proportionate and balanced way. Rather than safeguarding against exploitation in a supportive manner, the authority’s actions undermined the couple’s rights to dignity, equality, and personal fulfilment.

Ultimately, the ethical principles most visibly affected were dignity, respect, freedom, rights, and fairness, all of which are essential in ensuring equitable care and protection without unnecessary intrusion.

Ethical Principles, Communication, and Interpersonal Skills

This case demonstrates a clear breakdown in effective communication and the use of interpersonal skills that could have promoted dignity and respect. The local authority relied heavily on formal assessment procedures and legalistic interpretations of risk without establishing an empathetic dialogue with Sarah and her family.

Had the professionals adopted a more person-centred communication approach, they could have:

• Engaged Sarah in a respectful conversation that validated her feelings, rather than focusing on deficits.

• Applied accessible communication techniques (e.g., plain language, visual aids, supportive conversations) to ensure she understood the questions and decisions being made about her future.

• Practised active listening by genuinely considering Sarah’s views about love, marriage, and partnership, which she had already demonstrated an understanding of.

From an ethical perspective, communication should embody compassion, respect, and inclusion. Professionals should have balanced their duty of care with Sarah’s autonomy by engaging in dialogue that sought to support her, not undermine her. For example, rather than positioning her as a passive recipient of decisions, they could have co-produced a safeguarding plan that allowed the marriage while putting reasonable measures in place to ensure protection.

Additionally, interpersonal skills such as empathy, patience, and trust-building are essential for promoting dignity and respect in sensitive cases. By showing empathic understanding, professionals would have acknowledged Sarah’s emotional well-being as equally important as legal considerations. Instead, the communication approach taken heightened feelings of exclusion, disempowerment, and discrimination.
