Dobbs v. Jackson Women’s Health Organization is a significant Supreme Court case that originated in the state of Mississippi. In 2018, Mississippi passed the Gestational Age Act, which banned nearly all abortions after 15 weeks of pregnancy, except in cases of medical emergencies or severe fetal abnormalities. This law directly challenged the legal precedent set by the 1973 case Roe v. Wade, which guaranteed a constitutional right to abortion before fetal viability, generally considered around 24 weeks.
Jackson Women’s Health Organization, the only abortion clinic in Mississippi at the time, filed a lawsuit against Thomas Dobbs, the Mississippi State Health Officer. The clinic argued that the new law was unconstitutional and sought to block its enforcement. Lower federal courts, including the Fifth Circuit Court of Appeals, agreed with the clinic, ruling that the law was invalid under existing Supreme Court precedent. However, Mississippi appealed to the U.S. Supreme Court, which agreed to hear the case.
